      In the Name of God Amen. I William Howes of Tring in the county of Hertford Esquire being of sound and disputing mind and memory do make and publish this my last will and testament as follows. First I will that all my just debts and funeral expenses shall be fully paid and satisfied and other payments thereof and subject hereto give and devise my freehold messuage or tenement situate standing and being on Snow Hill in this parish of St Sepulchres London and now in the tenure or occupation of [blank space] from with stationer and all of my estate and interest therein unto and to the use of John Mulford of Basingstoke in the county of Hants esquire and Gilbert Burn of Newgate Street London Linen Draper and their heirs upon the trusts following that is to say upon trust during the life of my son John Howes to pay or permit and impower him my said son to receive the rents and profits of the said messuage or tenement to or for his own use and benefit and in case my said son shall at his death leave any issue of his body lawfully begotten then my will is that my said trustees and the survivor of my son and his heirs shall from trustees and the survivor of my son and his assigns and in case there shall be but one such issue of any said son then in trust for such only issue either son or daughter his or her heirs or assigns and in case my said son shall happen to die without any issue of his body lawfully begotten those my said trustees shall stand seized of the said messuage or tenement in trust for all and every such issue of my son to be equally divided between or among them if more than one share and share alike to take as tenants in common and their several and respective heirs and

      [P 52] assigns and in case there shall be but one such issue of my said son then in trust for such only issue either son or daughter his or her heirs or assigns and in case my said son shall happen to die without
      leaving any issue of his body lawfully begotten then my said trustees shall stand seized of the said messuage or tenement upon the trusts following (to wit) as to one moiety. The rents and profits which shall from time to time be received of the said messuage or tenement which shall from time to time be received during the life of my daughter the wife of Edward Cook upon trust to pay apply and dispose of the same such person or persons and for such uses and purposes as that my said daughter shall from time to time notwithstanding her ... and whether she shall be sole or married by writing under her hand direct or appoint to the intent and my will is that the same may not be at the disposal of or subject or liable to the cont.. debts or engagements of her present or any future husband that may hereafter marry but only at her own sole and separate disposal and in default of and until such d.. and appointment do and shall pay the same into the proper hands of my said daughter or permit and suffer them to receive the same whose receipt alone under her hand my will is shall from time to time notwithstanding her couverture be a sufficient discharge to the person or persons who shall so pay the same for so much thereof for which such receipt shall be given and in case my said daughter shall at her death leave any issue of her body lawfully begotten then my will is that my said trustees shall stand seized of and moiety of the said messuage or tenement in trust for all and every such issue of my said daughter to be equally divided or among them if more than one share and share alike and their several and respective heirs and assigns and in case there shall be but one such issue of my said daughter then in trust for such only issue wither son or daughter his or her heirs and assigns and in case my said daughter shall happen to die without leaving any issue then my will is that my said trustees shall stand seized of the said moiety of the said messuage or tenement in trust for my sure right heirs and as to the other moiety of the rents and profits of the said messuage or tenement in case of the death of my said son without issue as aforesaid which shall from time to time arise and be received during the life of my daughter the wife of George Frederick Herbst that my said trustees shall and do pay apply and dispose of the same unto such person or persons and for such uses and purposes as she my said daughter Martha Herbst from time to time notwithstanding her couverture
      [p 53] and whether she be sole or married shall by writing under her hand divert and appoint to the intent and my will is that the same may not be at the disposal of or subject or liable to the control debts or engagements of her present or any future husband she may hereafter marry but only at her own sole and separate disposal and in default of and until such direction and appointment shall and so pay the same whose receipt alone under her hand my will is shall be a sufficient discharge to the person or persons who shall be given and in case my said daughter Martha Herbst shall at her death leave any issue then my will is that my said trustees shall from henceforth stand seized of the other moiety of the said messuage or tenement in trust for all and every such issue of my said daughter Martha Herbst to be equally divided between them if more than one share and share alike and their several and respective heirs and assigns and in case there shall be but one such only issue this or her heirs and assigns and in case my said daughter Martha Herbst shall happen to die without leaving any issue than my will is that my said trustees shall stand seized of the said moiety of my said messuage or tenement first mentioned in trust for my right heirs. Also I give and bequeath unto the John Mulford and Gilbert Burn their executors and administrators the sum of fifty pounds a year annuities commonly called long annuities payable at the Bank of England upon the trusts following that is to say upon trust during so long of the term for which the said annuities were originally granted by parliament as my said son John Howes shall live to pay to or permit and suffer and impower him to receive the same and for his own use and benefit and in case my said son shall at his death leave any child or children of his body lawfully begotten then my will is that my said trustees for the time being shall stand and be possessed of the same long annuities in trust for all and every such child and children of my said son to be equally divided between
      or among them if more than one share and share alike as tenants in common and to their respective executors and administrators and if there shall be but one such child of my said son either son or daughter then in trust for such only child his or her executors or administrators and in case my said son shall happen to die without leaving any child or children of his body lawfully begotten
      p 54 then my will is that my said trustees shall stand and be possessed of the said long annuities upon the trusts following that is to say as to one moiety thereof upon trust to pay apply and disposes of the same unto such person or persons and for such use and purposes as she my said daughter Elizabeth Cook from time to time notwithstanding her couverture and whether she shall be sole or married shall be writing under her hand direct and appoint to the..intent and my will is that the same may not be the disposal of the subject or liable to the control debts and engagement of the present or any future husband she may hereafter marry but only at ther own said and separate disposal and in default of and until such direction and appointment to pay the same into the proper hands of my said daughter Elizabeth Cook or permit her to receive the same whose receipt alone under her hand my will is shall from time to time notwithstanding her couverture be a sufficient discharge to the person and persons who shall so pay the same for so much thereof for which the receipt shall be given and in case my said daughter Elizabeth Cook shall at her death leave any child or children then my will is that my said trustees shall from thenceforth stand possessed of the said moiety the same long annuities in trust and for the benefit of all and every the children of any said daughter Elizabeth Cook to be equally divided between or among them if more than one share and share alike and their several and respective executors administrators and assigns and in case there shall be but one such child of my said aughter Elizabeth Cook then in trust such only child either son or daughter his or her executors administrators or assigns and in case my said daughter Elizabeth Cook shall happen to die without leaving any child and children then my will is that my said trustee shall stand possessed of the said moiety of the long annuities in trust for the executors and administrator of my said son and as to the other moiety of the said long annuities in case of the death of my said son without leaving any child or children as aforesaid upon trust and my will is that my said trustees shall and so pay apply and dispose of the same unto such person or perons and for such uses and purposes as she my said daughter Martha Herbst from time to time notwithstanding the couverture and whether she shall be sole or married shall by writing under her hand direst and appoint to the intent and my will is that the same may not be at the disposal of or subject or liable to the control debts or engagements of her present or any future husband she may hereafter marry and

      p 55 in default of and until such direction and appointment to pay the same into the proper hands of my said daughter Martha Herbst whose receipt alone under her hand my will shall be a sufficient discharge to the person or persons who shall so pay the same for so much thereof for which such receipt shall be given and in case my said daughter Martha Herbst shall at his death leave any child or children then my will is that my said trustees shall form thenceforth stand possessed of the said last mentioned moiety of the said trust long annuities in trust for the benefit of all and every such children of my said daughter Martha Herbst to be equally divided between them (if more than one) share and share alike to... as tenants in common and their respective executors administrators assigns and case there shall be but one such child (of my said daughter Martha Herbst then in trust for such only child) either son or daughter his or her executors administrators and assigns and in case my said daughter Martha Herbst shall die without leaving any child or children then my will is that my said trustees their executors and administrators shall stand possessed of the said moiety of the said long annuities last mentioned in trust for the executors and administrators of my said son. Also I give and bequeath unto my said son John Howes all those my two leasehold messuages or tenements situate standing and being in Dunstans Court in the parish of St Dunstan in the West, London with their appurtenances to hold to him my said son his executors administrators and assigns for all the residue of the terms which shall be to come therein at the time of my decease to and for his and their own use and benefit and I also give to my said son John Howes the sum of forty five pounds a year short annuities of the year..? one thousand seven hundred and seventy nine {1779}payable also at the Bank of England being part of a sum of one hundred pounds a year of the sound short annuities now standing in my name to and for his own use and benefit. Also I give and bequeath unto the said John Mulford and Gilbert Burn their executor administrator the sum of fifty pounds a year a year other part of the said one hundred pounds short annuities upon the trusts following (that is to say) upon trust as to one moiety thereof to pay apply and dispose of the same during so long of the ... for which the said short annuities were originally granted by Parliament as she my said daughter Elizabeth Cook shall give unto such person or persons and for such uses and purposes as she my said daughter Elizabeth Cook from time to time
      p 56 notwithstanding the couverture and whether she shall be sole or married shall by writing uner her hand direct and appoint to the intent and my will is that the same may not be at the disposal of or subject or liable to the controul debts or engagements of her present or any future husband she may hereafter marry but only at her own disposal and in default of and until such direction and appointment to pay the same into the proper hands of my said daughter Elizabeth Cook or else to permit and suffer her to receive the same shoes receipt alone under her hand my will is shall from time to time notwithstanding her couverture be a sufficient discharge to the person or persons who shall so pay the same for so much thereof for which such receipt shall be given and in case my said daughter Elizabeth Cook shall at her death leave any child or children then my will is that my said trustees shall from thenceforth stand possessed of the said moiety of the said fifty pounds a year trust short annuities (in case they shall then exist) in trust and for the benefit of all and every such children to be equally divided between or among them (if more than one) share and share alike to take as tenants in common and their respective executors administrators or assigns and in case there should be but one such child then in trust for such only child his or her executors administrators or assign and in case my said daughter Elizabeth Cook shall die without leaving any child or children then my will is that my said trustees shall stand possessed of the said moiety of the said fifty pounds a year trust short annuities for my said son John Howes his executors or administrators and as to the other moiety of the said fifty pounds a year short annuities my will is that my said trustees shall stand possessed of the same upon trust to pay apply and dispose of the same during so long of the said term for which the said short annuities were originally granted as aforesaid as she my said daughter Martha Herbst shall live unto such person or persons and for such sues and purposes as she my said daughter whether she be sole or married shall by writing under her hand divest and appoint to the intent and my will is that the same may not be at the disposal of of subject or liable to the controul debts or engagements of her present or any future husband she may herafter marry but only at her own sole and separate disposal and in default of and until..... such direction and appointment to pay the same into the proper hands of my said daughter Martha Herbst or else permit and suffer her to receive the same whose
      p 57 receipt alone under her hand my will is hall from time to time notwithstanding her couverture be a sufficient discharge to the person or persons who shall so pay the same for so ... therof for which such receipt shall be given and in case my said daughter Martha Herbst shall at her death leave any child or children then my will is that my said trustees shall from thenceforth stand possessed of the said last mentioned moiety of the said fifty pounds a year trust short annuities in case they shall then exist in trust for the benefit of such children last mentioned equally to be divided between them if more then one share and share alike to take as tenants in common and their respective executors administrators and assigns and in case there shall be but one such child of my said daughter Martha Herbst then in trust for such only child his or her executors administrators and assigns and in case my said daughter Martha Herbst shall die without leaving any child or children my will is that my said trustees their executors and administrators shall stand and be possessed of the last mentioned moiety of the said fifty pounds trust short annuities in trust for my said son John Howes his executors and administrators and as to the remaining five pounds a year of the said one hundred pounds a year short annuities I give and bequeath the same unto the said John Mulford and Gilbert Burn their executors and administrators upon trust with the approbation of my said daughter Martha Herbst to lay out and invest the same .. the names of them my said trustees ... the time being from time to time as the same shall become due and be received in some of the publics funds or.. Government securities to accumulate for the benefits.. my granddaughter Harriet Herbst until she shall attain her age of twenty one years or be married which shall first happen and upon her attaining her said age of twenty one years or being married upon ... transfer and assign the same and the accumulated .. thereof unto my said granddaughter or as she shall direct or appoint and in case my said granddaughter Harriet Herbst shall die before she shall have attained her said age or be married then upon trust to transfer and assign the said funds and securities in which the said five pounds a year trust short annuities shall be vested unto all and every other the children of my said daughter Martha Herbst a shall be their living equally to be divided between them if more than one (share and share alike) and if but one then to such
      p 58 bank annuities part of a larger sum now standing in my name upon trust to lay out and invest in their ...names the dividends and interest thereof in some of the public funds or government securities to accumulate for the benefit of my grandchildren Thomas Cook, Margaret Cook, Sophia Cook and Charlotte Cook and my grandchildren Elizabeth Herbst, Martha Herbst, Margaret Herbst, Jane Herbst and Georgina Herbst equally share and share alike until they shall respectively be intitled to their respective shares of the principal fund and securities in which the dividends of the two hundred and twenty pounds four per cent bank annuities shall be vested as hereinafter is mentioned and my will is that my said trustees shall stand possessed of the said two hundred and twenty pounds four per cent bank annuities and the funds and securities in which the dividends and interest thereof shall from time to time be invested in trust and for the benefit of all every my said grandchildren the before named children of my said daughters Elizabeth Cook and Martha Herbst equally to be divided between and among them share and share alike the share of my grandson to be transferred on his attaining his age of twenty one years and the shares of my granddaughters to be transferred to them respectively on their attaining their respective ages of twenty one years or on the days of their respective marriages which shall die before their shares of and in the said trust funds and securities last mentioned shall become transferable then my will is that the share or shares of him her or them so dying? Of and in the same shall go and be transferred to the survivor of them at the same time as his her or their original share or shares is hereby made transferable. Also I give to my said daughter Elizabeth Cook the sum of twenty pounds to be paid her by my said executor immediately after my decease for mourning whose receipt alone without her husbands joining therein shall be a sufficient discharge to my executor for the same. Also I give to the said John Mulford the diamond ring I usually wear and to the said Gilbert Burn a ring of the value of five guineas. Also to the maidservant who shall have lived with me a twelvemonth at the time of my decease five pounds for mourning and I give to the Reverend Mr Williamson a ring of the value of one guinea and as to the rest and residue of my estate and effects whatsoever and wheresoever I give devise and bequeath the same unto my said son John Howes his heirs executors and administrators according to my Right and ... therein and I do hereby declare my will and mind to be that it shall and may be lawful to and for my said trustees and the survivor of them or
      p 59 any succeeding trustee or trustees to be appointed by virtue of the power herein after for that purpose given from time to time and at any time or times hereafter at their or his discretion to advance and pay to any one or more of my said grandchildren or to any person or persons to be by them any or either of them appointed for that purposes all or any part of his her or their portion or share of the monies herein before given to or appointed for them respectively before he she or they shall attain the age of twenty one years for his her or their preferment or advancement in the world and in such case no benefit of survivorship shall around from the death of such party so advanced or preferred before the age of twenty one so as that nothing in this clause contained shall be construed to compel my said trustees or trustee for the time being to make such payment or advancement against his own opinion and consent and further it is my will that my said trustees and the survivor of them and any succeeding trustee or trustees shall and may deduct and retain to themselves and himself respectively all such costs charges damages and expenses whatsoever which they or any or either of them shall pay sustain or be put onto in the execution or by reason or means of the trusts hereby in them reposes and that they and the survivor of them or any succeeding trustee the executors or administrators of them or any or them shall not nor shall any or either of them be answerable or accountable for any money which shall be received or come to the hand of them or any of them by virtue of or under the trusts hereby to them reposed otherwise than each person for what he shall respectively actually receive and not the one for the other of them or for ... receipts or defaults of the other of them but each and every of them for his own arts receipts and defaults only... for any involuntary loss that may happen by reason of the deficiency of any fund of security in which the said trust monies or any of them or any part thereof one or may be invested or for any other involuntary... whatsoever and in case my said trustees or either of them shall die or refuse to act in or desire to be discharged from the trusts hereby reposed in ...any time before all the said trusts shall be fully performed then it it my will that it shall and may be lawfully and I so hereby authorize and desire my said daughters Elizabeth Cook and Martha Herbst and the survivor of them and such other person or persons who shall be in the premises after the death of the survivor of them to nominate and appoint some other fit and proper person or persons to be a trustee or trustees of the premises in the room or place of the trustee or trustees so dying refusing to act or desiring
      p 60 to be discharged as aforesaid and that .... nomination or appointment the surviving or remaining trustee or trustees shall assign for ... and convey all and every part of the said trust estate and effects in such manner that the surviving or remaining estate and effects in such manner as that the surviving or remaining trustee or trustees and such person or persons so to be ... and appointed shall from thenceforth be jointly and equally concerned and interested in the several trusts herein before exposed in the same or like manner or remaining trustee or trustees and the party so dying refusing to act or desiring to be discharged would have been in case he or they had not died refused to act or desired to be discharged and so from time to time as often as it shall happen that any succeeding or other trustee shall die refuse to act or desire to be discharged before all the trusts aforesaid shall be performed such nomination and transfer shall be made as aforesaid it being my express will and desire that there be always two trustees of the said premises as long as any of the trusts herein before created shall remain to be performed and executed and I do hereby nominate constitute and appoint my said son sole executor of this my will and so hereby revoke al former wills by me at any time heretofore made and declare this to be my last will and testament in witness hereof I have to this my last will and testament contained in ten sheets of paper to the first nine sheets set my hand and to the last sheet my hand and seal this thirteenth day of May in the year of our Lord one thousand seven hundred and eighty six{1786}

      This is a codicil to the will of me the within named William Howes and to be taken and considered part thereof. I give devise and bequeath all that my freehold messuage or tenement and those of meadow and pasture and all those my estate situated at Aston Clinton and elsewhere in the county of Bucks with the appurtenances which I have purchased since the execution of my will within written into? And to the sue of the within named John Mulford and Gilbert Burn and their heirs upon the trust hereinafter mentioned that is to say upon trust to pay to or permit and suffer my son
      P 61 John Howes and his assigns during the term of his natural life to receive the rents issues and profits thereof to and for his and their own use and benefit and from and immediately after his decease in trust for all and every the child and children of my said son lawfully begotten if more than one to be equally divded among them share and share alike as tenants in common and their respective heirs and assigns and in case there shall be but one such child of my said whether son or daughter then in trust for such only child his or her heirs or assigns for ever and in case my said son shall happen to die without leaving any such child or children then my will is that my said trustees and the survivor of them and the heirs and assigns of such survivor of them shall stand seized of the said messuage or tenement close and premises with the appurtenances upon trust immediately after such decease of my said son without issue as aforesaid to pay the rents issues and profits thereof into the proper hands of my daughter Martha Herbst within named for and during the term of her natural life or to such person or persons and for such uses and purposes as she my said daughter shall from time to time notwithstanding the couverture and whether she shall be sole or married by writing under the hand direct or appoint to the intent that the same may not be at the disposal of or subject or liable to the control debts or engagements of her present or any future husband she may hereafter marry but at her own sole and separate disposal and I do hereby declare that the receipt and receipts of my said daughter or of such person as she shall from time to time appoint to receive the same shall be a good and sufficient discharge or discharges to my said trustees for the same or for so much thereof for which such receipt or receipts shall be given and in case my said daughter shall at her death leave any issue of her body lawfully begotten then my will is that my said trustees shall from and immediately after her death stand seized of the said messuage or tenement close and premises with the appurtenances in trust for all and every such issue of my said daughter so be equally divided between them if more than one share and share alike and their several and respective heirs and assigns and in case there shall be but one such child of my said daughter then in trust for such only child whether son or daughter his or her heirs and assigns and in case my said daughter shall die without leaving any issue then my will is that my said trustees shall stand seized of the said messuage of tenement close and premises with the appurtenances in trust for my own right heirs for ever and I do hereby ratify and confirm

      This will was proved at London with a codicil this fourth day of December in the year of our Lord one thousand seven hundred and eighty eight {1788}before the worshipful William Mattine doctor of laws surrogate of the knight worshipful Sir William Wynne Knight Doctor of Laws..... or Commisary of the prerogative court of Canterbury lawfully constituted by the oath of John Howes the son of the deceased and sole executor named in the said will to whom administration of all and singular the goods chattels and credits of the said deceased was granted he having first sworn duly to deliver.
