This is the last Will and Testament of me John Howse of Ampney Crucis in the County of Gloucester Gentleman First I give unto my two friends James Rice of St James’s London Esquire and William Martin of St George’s London Esquire the survivor of them his Executors and Administrators All and Singular my Messuages Lands Tenements Hereditaments and Premises with their rights and appurtances situate lying and being in the parishes of Ampney Crucis aforesaid Ampney St Peter Ampney St Mary or any or either of them or elsewhere in the said County of Gloucester and also all and singular my Household Goods and Furniture Plate Linen China Farming Stock and Implements of Husbandry Money and Securities for money and all other my Personal Estate and Effects of what nature or kind soever or wheresoever chargeable with the payment of my just Debts Funeral and Testamentary Expenses Upon Trust to xxxx and xxxx my Wife Sophia to receive and take the Rents Dues and profits of all and Singular my said Real Estates and to have hold and enjoy any said personal Estate and Effects for and during the term of her natural life provided she continues my Widow but not otherwise and from by and out of the same Rents Dues and profits to maintain breed up and educate my Children William Elizabeth John Jane Joseph Charlotte Sophia and in case my said Wife should marry then my Will is and I do hereby give unto her the Sum of Eight Hundred Pounds and direct my said Trustees or the Survivor of them his Executors or Administrators to pay the same due to her immediately on such marriage Either by and out of my said personal Estate or otherwise in their discretion by charge on my said Real Estates and I do hereby authorize and empower them my said Trustees or the Survivor of them his Heirs Executors or Administrators to raise the same thereon accordingly and declare that the receipt of my said Wife for the said sum shall be their or his official Discharge for the payment thereof and from and after the Decease or Second Marriage of my said Wife which shall first happen I give devise and bequeath unto the said James Rice and William Martin All and Singular my said Messuages Tenements Lands Hereditaments with their rights and appurtenances thereto belonging and also all my said Personal Estate and Effects of what nature or kind soever To hold unto them the said James Rice and William Martin their Heirs Executors Administrators and Assigns Upon Trust to sell and dispose of the same Real and Personal Estate and Effects Either by Public Auction or Private Contract for the most monies that can be had or gotten for the same and the monies arising therefrom to place out at Interest on Government or good and sufficient Freehold Security or Securities and by and out of the Dividends and Interest thereof to maintain breed up and educate my said Six Children and when and as they shall respectively attain their ages of 21 years to pay him or her his or her equal sixth part or share of such product or whole Principle Sum of my said Real and Personal Estate and Effects and if any or either of my said Children shall happen to die before his her or their having attained the Age of 21 years then I do hereby direct that the share of shares of him her or them so dying shall be paid and equally divided unto and amongst the Survivor or Survivors of them having attained such age his her or their Executors or Administrators And I do hereby declare that the Receipt and Receipts of the said James Rice or William Martin or the survivor of them his Heirs Executors Administrators or Assigns shall be a good and official Discharge or good and official Discharges to the purchaser or purchasers of my said Real Estate or any part thereof for his her or their respective consideration or purchase monies and that the purchaser or purchasers shall not afterwards be bound or answerable for tax application misapplication or non application of his her or their respective purchase monies And I do hereby make constitute and appoint my said Wife Sophia and the said James Rice and William Martin joint Executrix and Executors In Trust of this my last Will and Testament hereby revoking all of and by me at any time heretofore made and I declare that the said James Rice and William Martin shall not be Answerable or Accountable the one for the other of them or for the xxxx receipts xxxx or default of the other of them nor for the insufficiency of the Security of Securities whereupon the said Trust monies or any part thereof shall be placed or invested nor for any other misfortune loss or Damage which may happen in the execution of the aforesaid Trusts unless the same respectively happen by or through their own willful neglect or default And lastly I hereby direct that the said James Rice and William Martin and the survivor of them and his Heirs Executors or Administrators of such Survivor shall and may by and out of the aforesaid Trust monies retain to and reimburse themselves and himself all Costs Charges Damages and Expenses which shall necessarily attend the execution of the Trusts of this my Will In Witness whereof I have to this my last Will and Testament contained in two sheets of paper set my hand to the first sheet hereof and my hand and Seal to this Second sheet hereof this fifth day of September in the year of our Lord 1808 Jn Howse Signed Sealed Published and declared by the said Testator John Howse as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as Witnesses hereto. Proved at London on 11th January 1812 before the Worshipful Samuel Pearson Parson Dr of Laws and by the Oaths of James Rice and William Martin two of the Executors they being first sworn duly to administer – Power to Sophia Howse Widow the First and other Executor
